The petitioner being superannuated from the post of Assistant Accounts Officer in the Multi State Cooperative Land Development Bank (hereinafter referred to as the 'Bank') has approached this Court seeking a direction upon the Managing Director of the Bank and the Provident Fund Officer, Patna to ensure payment of Rs.8,53,835/- to the petitioner towards the Contributory Provident Fund along with the statutory interest.

Learned Advocate for the petitioner adverting to the facts narrated in the writ petition has contended that the Managing Director of the Bank vide letter No. 2503 dated 27.07.2019 intimating the Assistant Provident Fund Commissioner, Regional Office, Patna for payment of provident fund amount to the retired employees of the Bank. The petitioner's yearly contributory provident fund amount from 1987-88 to 2019-20 is calculated at Rs.16,06,193.61. Repeated representations have been made but till date the same has not been paid compelling him to approach this Court. From the records, it is explicit that the respondent no. 2 sent a claim through Form-19 to the respondent EPFO office on 05.08.2019 and by virtue of Form-19, the respondent Bank directed to make payment to the petitioner only of an amount of Rs.8,53,835/-. Learned Advocate for the petitioner thus contended that the rest amount of Rs. 7,52,358.61 has yet to be paid to the petitioner.

Considering the submissions advanced on behalf of the parties and taking note of the limited grievance, this Court deems it fit and proper to dispose of the writ petition with a direction to the respondent no. 2 to verify the claim of the petitioner and send prescribed Form-19 to the Employees Provident Fund Office, Patna for payment of remaining

5. Needless to say that on receipt of Form-19 the EPFO shall ensure payment of the admissible amount within a further period of four weeks, in accordance with law.

6. The writ petition stands disposed off.
