1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Bihariganj Police Station Case No. 311 of 2024, disclosing offences under Sections 310(6) of the BNS and under Section 27 of the Arms Act.
3. As per the prosecution case, on 13.09.2024 while the informant, along with his nephew, was going to his sister's house on motorcycle, he was waylaid by two persons sitting on motorcycle. The accused persons attempted to rob the informant and snatched mobile phone and key of the motorcycle at gunpoint. When the informant protested, one of the miscreants shot fire upon the informant due to which he sustained bullet injury in his stomach and when informant's nephew intervened the
Patna High Court CR. MISC. No.21068 of 2025(2) dt.23-04-2025 2/3 accused persons also fired upon him but he had a narrow escape.
4. Learned Counsel for the petitioner submits that the petitioner has not committed any offence and the manner alleged and he has falsely been implicated in this case on the basis of suspicion only. The petitioner is having no criminal antecedent.
5. Learned counsel for the State opposed the prayer for anticipatory bail.
6. I have heard learned counsel for the parties and also the materials on record including the impugned order.
7. From the impugned order, it appears that during investigation the complicity of the petitioner has been found in the present occurrence along with co-accused Chandrashekhar Kumar and the police has found the case true against the petitioner. The investigation is still going on in this case. It appears that prima-facie material has come during course of investigation which can be basis of the further investigation for which the custodial interrogation of the petitioner may be required. Considering the nature of the allegation, the materials collected during the investigation and the fact that the
Patna High Court CR. MISC. No.21068 of 2025(2) dt.23-04-2025 3/3 investigation is still going on, I am not inclined to grant the petitioner privilege of anticipatory bail.
