JUSTICE SANJAY PRIYA ORAL ORDER 26-09-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in POCSO Case No. 106 of 2018 arising out of Shastri Nagar P.S. Case No. 348 of 2018 instituted for the offence under Sections 452, 341, 354(A), 354(B), 354(C), 354(D) /34, 506, 509 of the Indian Penal Code, Section 12 of POCSO Act and Section 66 of I.T. Act. Counsel for the petitioner submits that petitioner is in custody since 14.06.2018. Counsel for the petitioner further submits that in the written report it is alleged that occurrence has taken place about three months back, but the informant did not file any case earlier before the police. The matter appears to be of love affair between petitioner and informant. In the written report is alleged that petitioner along

Patna High Court Cr.Misc. No.51545 of 2018 (2) dt.26-09-2018 2/2 with his friends used to tease the informant. The petitioner gave threat to the informant to send her photo on Facebook and Whatsapp.

The informant (victim girl) has given statement under Section 164 Cr. P.C. making almost similar allegation as alleged in the written report.

There is general and omnibus allegation against the petitioner in the written report.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-1st-cum-Spl. Judge, POCSO, Patna, in connection with POCSO Case No. 106 of 2018 arising out of Shastri Nagar P.S.
