JUSTICE ARUN KUMAR ORAL ORDER 13-12-2017 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Naurangia PS Case No. 4 of 2016 registered under Section 392 of the IPC. The allegation in brief is that the informant's Bolero vehicle was robed by the two named accused Adha Kewat and Munna Kushwaha identified by the informant's driver and one unknown person. The robbed vehicle is said to be used in a bank dacoity case viz Dhandaha PS Case No. 5 of 2016, in which the petitioner was also accused.

Learned Counsel for the petitioner submits that the petitioner is not named in the FIR and made accused on the basis of confessional statement of the co-accused in Dhandaha PS Case No. 5 of 2016 and remained in custody in the said case from 5.3.2016 to 30.8.2017, the date on which the petitioner was granted bail by this Court thereafter on the subsequent day he was remanded in the present case. He was never put on TIP in the present case while he was in custody and remanded in this case. Moreover charge sheet has also been submitted in this case without putting the petitioner on TIP. No.57913 of 2017 (2) dt.13-12-2017 petitioner, namely, Sunil Yadav is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM II, Bagaha, West Champaran in connection with Naurangiya PS Case No. 4 of 2016.
