JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-05-2019 Petitioner seeks bail in anticipation of his arrest in connection with Bathanaha P.S. Case No. 295 of 2018 registered for the offences punishable under Sections 272, 273/34 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act.
Allegation as per FIR is that police on received that huge quantity of liquor was kept in the house of the petitioner raided the house of the petitioner and recovered 1620 litres of Npali Saufi liquor from near the house of the petitioner and petitioner fled away.
Submission of learned counsel for the petitioner is that nothing has been recovered from his conscious possession or from his house and he has no criminal antecedent. Heard learned APP also.
Patna High Court CR. MISC. No.20157 of 2019(3) dt.07-05-2019 2/2 In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. He may surrender and pray for regular bail, which shall be considered on the basis of materials available on the record and, if possible, to be disposed of on the same day.
