10-08-2016 Heard Sri Shiv Shankar Prasad Singh, learned counsel, who was assisted by Sri Vijay Kumar, learned counsel for the petitioner and Sri Madan Kumar, learned Addl. Public Prosecutor.

This is the 2nd attempt for grant of bail on behalf of petitioner. Earlier, by order dated 01-12-2015, the prayer for bail of the petitioner was rejected, vide Cr. Misc. No. 52062 of 2015. The petitioner is in custody since 03-09-2015 in Amarpur (Fullidumar) P.S. Case No. 157 of 2015 registered for the offence under Section 307 & other allied sections of the Indian Penal Code and Sections 25(1-B)A, 26 & 27 of the Arms Act, 1959. It was submitted by learned counsel for the petitioner that even though prayer for bail of petitioner was earlier rejected

Patna High Court Cr.Misc. No.30719 of 2016 (3) dt.10-08-2016 2/2 in the month of December, 2015, till date before the court below, no adequate progress has taken place.

Keeping in view the nature of accusation as well as statement of learned counsel for the petitioner that no adequate progress has taken place before the court below, let the petitioner namely Sanjeev Panjiyara be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Amarpur (Fullidumar) P.S. Case No. 157 of 2015, on condition that one of the bailor must be blood relation of the petitioner and secondly, on each and every date during the trial, the petitioner shall remain physically present before the trial court. If continuously on two dates, he fails to appear before the court below, without prior permission of the trial court, his bail bond shall stand automatically cancelled. (Rakesh Kumar, J.) Anay U T
