2. Petitioner seeks regular bail in connection with Siwan Excise P.S. Case No. 675 of 2023 dated 01.07.2023 in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.
3. As per prosecution case, altogether 558 litres illicit liquor was recovered from different vehicles and a house and out of 558 litres, 90 litres of illicit liquor was recovered from the joint house of the petitioner.
4. Learned counsel for the petitioner submits that petitioner has clean antecedent and he has falsely been implicated in the present case merely on the basis of suspicion.
Patna High Court CR. MISC. No.19456 of 2025(2) dt.16-05-2025 2/2 Nothing has been recovered from the conscious possession of the petitioner. Petitioner is in custody since 09.02.2025.
5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Judge-II, Siwan in connection with Siwan Excise P.S. Case No. 675 of 2023.
