The petitioner is in custody in connection with Manjhi P.S. Case No.183 of 2017 and N.D.P.S. Case No.18 of 2017, a case under Sections 20/22 of the N.D.P.S. Act. 800 grams of Ganja was allegedly recovered from possession of the petitioner. Petitioner has stated on oath that he has got no criminal antecedent.

Submission is that the available case-diary would reveal that the petitioner has got no criminal antecedent. There is non-compliance of the mandate of recovery as directed under Section 52 of the Act. Moreover, the recovered Ganja comes within small quantity.

No.58252 of 2017 (3) dt.01-02-2018 P2/ Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with the aforesaid case, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
