Petitioners seek bail in a case registered for the offences punishable under Sections 302,120B and 34 of the Indian Penal Code.
When the informant came to his house he was informed that his nephew had fallen down from the roof. Subsequently, he came to know that nephew was assaulted by the petitioners. During course of treatment, the nephew died.
Learned counsel for the informant opposed the prayer for bail on the ground that the matter is of circumstantial evidence. Hence, perusal of the case diary is

Considering the facts and circumstances of this case, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Digha Police Station Case No.177 of 2018, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioners shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
