Petitioner seeks bail in a case registered for the offences punishable under Sections 376, 384, 385, 420, 120B of the Indian Penal Code and Section 3/4 of the Protection of Children from Sexual Offenses Act, 2012.

Though allegation is of commission of rape, however, the victim denied the same in the petition filed before the learned court below.

A copy of the same is at page 23 of the bail petition.

Submission is that just to pressurize for marriage, false case has been lodged.

Hence, let the petitioner, above named, be

Patna High Court Cr.Misc. No.57418 of 2018 (2) dt.20-09-2018 2/2 released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Spl. (POCSO) Case No. 08 of 2016 arising out of Jogbani P.S. Case No. 31 of 2016, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner as well as condition that both the bailors shall be resident of the territorial jurisdiction of the learned court below.
