JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-06-2019 Petitioner seeks bail in anticipation of his arrest in connection with Piri Bazar P.S. Case No. 02 of 2019 registered for the offences punishable under Sections 323, 504, 506, 354B, 354C, 354D/34 of the Indian Penal Code, Sections 66A (E), 66(A) of I.T. Act and Sections 7/8 of POCSO Act. Allegation against the petitioner is of making obscene photographs of the daughter of the informant viral and also of outraging her modesty.

Submission of learned counsel for the petitioner is that the mobile used is not of the petitioner and he has falsely been implicated.

Heard learned APP also, who has opposed the prayer for anticipatory bail on the ground that the nature of allegation is very serious.

He may surrender and pray for regular bail, which shall be considered on the basis of materials available on the record.
