Heard learned counsel for the petitioner and the State. The petitioner prays for grant of bail in a case registered for the offence punishable under section 304B/34 of the Indian Penal Code.
As per prosecution case, daughter of the informant was solemnized with co-accused Ranjeet Ray in the year 2017 and thereafter, this petitioner along with co-accused subjected her to torture for giving dowry. Accused persons are alleged to have sprinkled kerosene oil on the body of daughter of the informant and lit her on fire causing her death on account of serious burn injuries. It is submitted on behalf of petitioner that the petitioner is father-in-law of deceased and there is general and omnibus allegation. Petitioner is separate in mess and property with the
Patna High Court CR. MISC. No.28847 of 2021(2) dt.12-08-2021 2/2 husband of the deceased and husband of the deceased is already in custody. Petitioner is in custody since 20.06.2021. Learned counsel for the State opposes the prayer for bail.
Considering the facts and circumstances of the case, this bail application is allowed. Let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate I, Danapur, Patna in Shahpur P.S. Case no. 349/2018 on the following conditions.
(1) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present as directed by the Court and on his/her absence on two consecutive dates without sufficient reason, his/her bail bond shall be canceled by the Court below.
(2) If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.
