JUSTICE HARISH KUMAR ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date : 23-04-2024 The writ petition filed as a PIL seeks to ensure the safety and security norms in facilitating new retail outlets of petroleum products to be in consonance with Indian Road Congress-2009 based on which Ministry of Road Transport and Highway (MORTH) have issued Annexure-P1 and P1/1 guidelines.
2. The petitioner in the writ petition itself was concerned with the establishment of only one petrol pump at Kanti Motipur Road in village Mahima Gopinathpur Thana No. 236 located in Khata No. 359, Plot No. 177 of Motipur Block, District-Muzaffarpur.
3. Later, the petitioner has sought to implead the allottee of the petrol pump. Obviously, this is not a Public Interest

4. In such circumstance, we cannot entertain the matter as a Public Interest Litigation and dismiss the same specifically finding that there is no reason to invoke the extraordinary remedy that too by an application filed as a PIL.
