JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-09-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147,341,323,324,504 and 506 of the Indian Penal Code and section 3(1) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act.

It is alleged that the accused persons used to take liquor, gamble and drive motorcycle at high speed near the house of the informant which was protested by the informant when the informant was assaulted, abused by calling the caste name and his mobile was snatched.

It is submitted by the learned counsel for the petitioners

Patna High Court Cr.Misc. No.36291 of 2015 (2) dt.08-09-2015 2/2 that for the occurrence of 28.1.2015 the FIR was registered on 20.2.2015 and at earlier point of time on 1.2.2014 the petitioners side lodged Cheria Bariyarpur P.S. Case No. 13 of 2015 making accusation under sections 147,148,341,323,324,386,379,504,506 and 307 IPC against the informant and others. Considering the delayed lodging of the case, the case lodged by petitioners side at earlier point of time and Statement made in paragraph 3 of the petition that the petitioners have no criminal antecedent, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM, Begusarai in connection with Begusarai SC/ST P.S. Case No.4 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
