Petitioner seeks bail in Kateya P.S. Case No. 133/2015, registered for the offences punishable under Section 392 of the Indian Penal Code.
Informant alleged that on 08.08.2015 after withdrawing Rs. 10,000/- from the State Bank of India, Kateya he was going to his village. In the way he took lift in Bolero vehicle. Three persons were already sitting in that vehicle. Out of them, one person on the gun point, snatched his money and voter identity card and all the accused persons fled away.
It has been submitted that petitioner is not named in the F.I.R. In Kateya P.S. Case No. 1191/2015 three persons including
Patna High Court Cr.Misc. No.51664 of 2018 (2) dt.04-10-2018 this petitioner were arrested. Money and voter identity Card of the informant were recovered from them. Petitioner was remanded in this case on 31.05.2018 since then he is in custody. Considering the fact that voter identity card of informant was recovered from the possession of petitioner, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.
Petitioner may renew his prayer for bail after completing one year in custody.
