Mr. Binod Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 12-07-2023 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 354(B), 504, 506 of the Indian Penal Code. The informant alleges that when he along with his family members was returning from the field when seven named accused persons including the petitioners intercepted the path and asked the informant to leave Hindu religion and to accept Christianity then only she would be allowed to cross the path, it is next alleged that informant protested when all the accused

Patna High Court CR. MISC. No.22947 of 2023(2) dt.12-07-2023 2/3 hurled abuses and Manohar Tuddu assaulted Sukhu Tuddu with tangi causing injury on his left hand, thereafter, Nausen Tuddu assaulted the wife of the informant with brick causing swelling, it is next alleged that Anjlus Tuddu assaulted niece of the informant with fist on her chest and tore her cloths and thereafter, all the accused assaulted the informant and his daughter with legs and fist.

Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and petitioner No. 1 is a women.

Learned counsel for the petitioners submits that the petitioners have been falsely implicated in the present case, it is next submitted that there is a case and a counter case and there is land dispute between the parties and even presuming what has been alleged is true without admitting then the injuries suffered by the injured were alleged to have been assaulted by the petitioners is simple in nature as would be evident from Annexure 2 to the anticipatory bail application. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the

No.22947 of 2023(2) dt.12-07-2023 3/3 event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Chakai P.S. Case No. 304 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
