JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Sections 323, 354 and 504 of the Indian Penal Code.

The prosecution case is that while the complainant was sleeping in her room when this petitioner on the point of knife ravished her.

It is submitted by learned counsel for the petitioner that for the occurrence of 01.08.2013, the complaint has been filed on 08.10.2013 and the accusation under section 376 IPC was not found true during investigation and the processes has been directed to be issued after taking cognizance under sections 323, 354 and 504 of the Indian Penal Code. The petitioner has also filed

Patna High Court Cr.Misc. No.32549 of 2015 (2) dt.11-08-2015 2/2 Jalalgarh P.S. Case No.136 of 2013 against the complainant and others since the petitioner purchased certain properties, and the complainant was creating hindrance in taking possession of the said properties.

Considering the delayed lodging of the complaint, the accusation has been levelled in the background of land dispute and litigated relationship between the parties, moreover, the petitioner lodged case at earlier point of time, let him be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Purnea in connection with Complaint Case No.1167 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
