Petitioner, who is in custody, seeks bail in connection with Nayagaon P.S. Case No. 107 of 2017 registered for the offences punishable under Sections 399, 402 and 414 of the Indian Penal Code and under Sections 25(1-b)a, 26 and 35 of the Arms Act.
Informant who is a police officer has stated that on a secret information he along with other police personnel reached the said place and apprehended petitioner along with other co-accused and on search of their persons recovered one loaded pistol and one mobile from the possession of petitioner. It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been
Patna High Court Cr.Misc. No.56186 of 2018(2) dt.06-10-2018 2/2 falsely implicated in this case. He is in custody since 03.11.2017. It has been further submitted that similarly placed co-accused has been granted bail by co-ordinate Bench of this Court in Cr. Misc. No. 61821 of 2017 vide order dated 19.12.2017.
Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. -13th, Saran at Chapra in connection with Nayagaon P.S. Case No. 107 of 2017.
