JUSTICE MADHURESH PRASAD ORAL ORDER 19-12-2017 Heard learned counsel for the petitioners and the State. The petitioners seek regular bail in a case registered for offence under sections 341, 323, 307, 379/34 of the IPC and section 27 of the Arms Act.
Counsel for the petitioners submits that from perusal of the FIR and the case diary it is evident that there is no allegation of assault attributed on petitioner no.2 and the injuries sustained by the informant is not on his vital part rather on the shoulder. Petitioners are in custody since 17.9.2017 having no antecedent. The prayer for bail of the petitioner no. 2 Laxman Manjhi is allowed. He is directed be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate 13, Saran at Chapra in Parsa Police Station Case No. 147 of 2017 on the following conditions:- (a) One of the bailors will be a close relative of the petitioner no. 2 who will give an affidavit giving genealogy as to how he is related with him. The bailor will also undertake to inform the court if there is any change in the address of the
Patna High Court Cr.Misc. No.56551 of 2017 (3) dt.19-12-2017 petitioner.
(b) The petitioner no.2 will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
Prayer for bail of the petitioner no. 1 Satyendra Rai @ Satendra Rai is rejected for the present.
