JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-04-2019 Earlier the prayer for bail of the petitioner was dismissed vide order dated 17.07.2017 passed in Cr. Misc. No. 11770 of 2017 and allegation against the petitioner is committing murder of brother of informant.

Submission of learned counsel for the petitioner is that there was direction of this court to conclude the trial within a period of one year and evidence has also been closed but the prosecution filed a protest petition and after rejection of the protest petition, the prosecution has again filed a petition under Section 319 of Cr.P.C. and petitioner has been languishing in judicial custody since 05.12.2016. Heard learned A.P.P. also.

Having heard both sides, in view of the above facts,

Patna High Court CR. MISC. No.17631 of 2019(2) dt.04-04-2019 2/2 let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, Dalsingsarai, Samastipur, in connection with Dalsingsarai P.S. Case No. 351 of 2016, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
