JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 341, 323, 504, 506 and 387 of the Indian Penal Code. Petitioner happens to be son of the informant and the informant has levelled allegation that petitioner demanded Rs.10,000/- per month as Rangdari from him.
Submission on behalf of the petitioner is that the informant is habitual litigant and, as a matter of fact, he has not only filed several cases against the petitioner but also against his father as well as elder brother prior to institution of the present case It is further submitted that, as a matter of fact, there is family
Patna High Court Cr.Misc. No.35080 of 2016 (2) dt.22-08-2016 2/2 dispute between the parties and petitioner is in jail custody since 25.2.2016.
On the other hand, learned counsel appearing for the informant opposed the prayer submitting that earlier petitioner was convicted in a criminal case and petitioner does have criminal antecedent.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, Court No.2, Buxar in connection with Buxar (T) P.S.
