KUMAR ORAL ORDER 08-02-2018 Heard learned counsel for the petitioners and learned counsel for the State and learned counsel for the informant. The petitioners seeks bail in Buniyadganj P.S. Case No. 115 of 2012 registered for the offence punishable under Sections 341, 324, 307 and 34 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation against the petitioners is of causing fire arm injury to the informant.
Informant Bhola Nath Singh in his fardbeyan had alleged that on 11.10.2012, while he was returning from his motorcycle to his house at about 9:30 am, five accused persons on two motorcycles overtook and stopped his motorcycle and
Patna High Court Cr.Misc. No.1732 of 2018(3) dt.08-02-2018 2/3 accused Satyendra Singh ordered to kill informant upon which Dharmendra Kumar Singh, Ravindra Kumar Singh and Sajjan Singh fired from their revolver causing injury on his face and right hand and thereafter, they fled away and he was carried to hospital for treatment.
It has been submitted on behalf of the petitioners that they are innocent and have been falsely implicated in this case due to old enmity and land dispute. One of the accused Satyendra Singh is A.S.I. of police (Special Branch) and was posted at Gaya Airport on said date, which has been verified during investigation and has been found to be true. Brother of informant is accused in murder of father of Satyendra Singh and trial against him is going on in which petitioners are witnesses and to put pressure upon them this false case had been lodged. Many witnesses who have been examined in this case have not supported informant's case. Previous enmity and land dispute is admitted. In spite of several efforts made by I.O. he cannot get the injury report from the hospital. One Jitendra Kumar Singh, who was arrested by the police in Gaya Muffasil P.S. Case No. 111 of 2013 had confessed, apart from other cases, his involvement in this case along with other accomplice of firing upon Bhola Singh which also finds support from some
Patna High Court Cr.Misc. No.1732 of 2018(3) dt.08-02-2018 3/3 witnesses statement made during investigation. There are more than dozen cases lodged by parties against each other. Learned counsel for the informant vehemently opposes the prayer for bail and states that there is direct allegation against the petitioners of firing upon the informant. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Buniyadganj P.S. Case No.115 of 2012.
