The petitioner apprehends his arrest in connection with Trial No. 2011 of 2017, arising out of Excise Case No. 21 of 2010, registered under Section 47(A) of the Excise Act. The accusation is that in course of raid made by the excise department on 23.05.2010, the petitioner succeeded to flee away, but from his Meat shop, 25 pouches, each containing 200 ML country made liquor recovered kept in a plastic bag. Learned counsel for the petitioner submits that, in fact, petitioner was not apprehended on the spot. Further submission is that the alleged Meat shop was not belongs to the petitioner. The petitioner has falsely been implicated in this

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the 7th Addl. Sessions Judgecum-Special Judge, Excise Act, East Champaran at Motihari in connection with Excise Case No. 21 of 2010, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
