Heard learned counsel for the petitioner and the learned APP for the State.

Petitioner seeks regular bail in connection with Railway Patna Gaya Junction P.S. Case No.460 of 2022 dated 30.11.2022 registered for the offences punishable under Sections 399 and 402 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act.

The main submissions advanced by the learned counsel for the petitioner are that as per the allegation six persons were apprehended near railway station and from the possession of some of the co-accused persons fire-arms were recovered but from the possession of this petitioner only one mobile phone is stated to have been recovered and the petitioner

Patna High Court CR. MISC. No.22076 of 2023(2) dt.29-04-2023 2/2 has fair and clean antecedent and has been languishing in jail since 30.11.2022 and against him the investigation has been completed.

Learned APP appearing for the State has opposed the bail prayer.

Considering the above submissions, in the opinion of this Court a lenient approach can be taken in respect of the petitioner's prayer, let the petitioner be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Railway Patna Gaya Junction P.S. Case No.460 of 2022.
