2. Petitioner is in custody in a case registered for an offence punishable under Sections 25 (1-B)(a), 26 of Arms Act.

3. As per the prosecution case, on 14.10.2024 informant, namely, Rakesh Kumar ASI-cum-O/c Bhargama P.S along with police party proceeded with the present petitioner who was accused of Bhargama P.S. Case no.111 of 2024 for recovery of arms used in the said case as the present petitioner has confessed that arms used in the said case were thrown in a bush situated near Tinkonma Gate, on said confession one country made pistol and two live cartridges were recovered by the informant.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case and he is not named in the FIR. Petitioner is in custody

Patna High Court CR. MISC. No.19504 of 2025(2) dt.16-04-2025 2/2 since 14.10.2024. He further submits that petitioner has got three criminal antecedents as stated in para-3 of the bail petition. He further submits that in Bhargama P.S Case No.111 of 2024 one accused, namely, Md. Sakir arrested by the police and on the basis of his confessional statement, the present petitioner was remanded in the said case and after interrogation the petitioner disclosed the place where he has thrown the arms which were used in the said offence. He further submits that after confessional statement of the present petitioner, the police lodged the present case.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

Considering the aforesaid facts and circumstances of the case and submission made on behalf of the learned counsel for the petitioner, let the above named petitioner be released on bail, on his furnishing bail bonds of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Araria in connection with Bhargama P.S. Case No.310 of 2024. (Ramesh Chand Malviya, J) Harshita/- U T
