Petitioner, who is in custody, seeks bail in connection with Chapra Muffasil P.S. Case No. 32 of 2018 registered for the offences punishable under Sections 304 B, 324 and 34 of the Indian Penal Code.
Informant who is the brother of the deceased has alleged that petitioner along with his family members killed his sister by setting her ablaze due to non-fulfillment of demand of dowry.
It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been falsely implicated in this case only because he is in-law of the deceased. Deceased has accidently caught fire while she was
Patna High Court Cr.Misc. No.56888 of 2018(2) dt.06-10-2018 2/2 cooking. Allegation of demand of dowry and torturing is false. He has no criminal antecedent and he is in custody since 26.01.2018. It has been further submitted that similarly placed co-accused persons have been granted bail by co-ordinate Bench of this Court in Cr. Misc. No. 27290 of 2018 vide order 09.05.2018.
Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Chapra Muffasil P.S. Case No. 32 of 2018.
