JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a complaint case filed with accusation under Sections 147,323,504,506,427,341 and 380 of the Indian Penal Code.
It is alleged that the accused persons entered into the house of the complainant, robbed articles, made assault and demolished the house of the complainant.
It appears that the complaint was filed in 2005 and the order of cognizance was passed on 26.7.2005 but in spite of issuance of process under section 82 Cr.P.C. the petitioner did not appear.
It is submitted by the learned counsel for the petitioner that the petitioner belongs to different district and never any
Patna High Court Cr.Misc. No.34994 of 2015 (2) dt.19-08-2015 2/2 process was executed against the petitioner.
Let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Complaint Case no. 85 of 2005 pending in the court of learned J.M. Ist Class, Banka. This application is disposed of with the aforesaid observation/direction.
