JUSTICE MOHIT KUMAR SHAH ORAL ORDER 18-01-2018 Heard the learned counsel for the petitioner and the learned APP for the State.
The petitioner seeks regular bail in connection with Dehri (Nagar) P.S. Case No. 862 of 2017 for the offences punishable under Sections 30(a), 34 and 37 of the Bihar Prohibition and Excise Act, 2016.
The allegation is regarding recovery of 8 liters of illicit liquor from a paddy field where the petitioner is said to have been standing and was apprehended from the said field. The learned counsel for the petitioner submits that the paddy field does not belong to the petitioner and no recovery has been made from his conscious possession and he is in custody since 1.11.2017.
Considering the nature of accusation and the period
Patna High Court Cr.Misc. No.651 of 2018 (2) dt.18-01-2018 2/2 of custody already undergone, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Dehri Rohtas at Sasaram in connection with Dehri (Nagar) P.S.
