JUSTICE MADHURESH PRASAD ORAL ORDER 17-02-2018 Heard counsel for the petitioners and the State. Petitioners are accused in a case registered for offence under sections 341, 323, 379, 307, 504, 302, 506/34 IPC. Counsel for the petitioners submits that there was a free fight between the parties due to land dispute for which one another case bearing Barharia Police Station Case No. 168 of 2017 was also lodged on 8.6.2017 in relation to the same occurrence in which informant of that case received head injuries. The specific allegation is attributed to Md. Rafi Ansari. Petitioners have no antecedent and are in custody since 17.6.2017 and 19.6.2017 respectively.

Considering the aforesaid submissions, prayer for bail of the petitioners is allowed. Let both the petitioners, mentioned

Patna High Court Cr.Misc. No.63387 of 2017 (3) dt.17-02-2018 above, be released on bail on furnishing bail bond of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan in Barharia Police Station Case No. 169 of 2017 on the following conditions:- (a) One of the bailors will be a close relative of the petitioners who will give an affidavit giving genealogy as to how they are related with the petitioners. The bailor will also undertake to inform the Court if there is any change in the address of the petitioners.

(b) The Petitioners will be well represented on each date and if they fail to do so on two consecutive dates, their bail will be liable to be cancelled.
