JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report and it appears that in course of investigation, the name of petitioner came in this case in the statement of informant which has been incorporated by the I.O at para-75 of the case diary. Submission on behalf of the petitioner is that petitioner is co-villager as well as next door neighbour of the informant and had the petitioner participated in the alleged crime, he would certainly been identified by the informant as well as her family members but neither informant nor her family members disclosed the name of the petitioner at the time of institution of the present case. It is further submitted that as a matter of fact, the mother of

No.30330 of 2016 (2) dt.04-08-2016 2/2 the petitioner was working as maid- servant in the house of the informant and she left her work which caused annoyance to the informant and an altercation had taken place between them and that is the reason of false implication of the petitioner in the present case.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate,-IV, Samastipur in connection with Musari Gharari P.S.Case No. 45 of 2016.
