JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-02-2018 Earlier prayer for bail of the petitioner was dismissed vide order dated 08.05.2017 passed in Cr. Misc. No. 20023 of 2017 with direction to the trial court to expedite and conclude the trial within a period of six months and petitioner was given the liberty to renew his prayer for bail, if the trial is not concluded within the aforesaid period.

Submission of learned counsel for the petitioner that petitioner has been in judicial custody since 11.03.2017 and uptil now trial has not been concluded and there is no specific allegation against him.

Heard learned A.P.P. also.

Earlier a report was called for from the court below with regard to stage of trial, from which it appears that out of

Patna High Court Cr.Misc. No.719 of 2018 (3) dt.08-02-2018 2/2 seven witnesses, three witnesses have already been examined, as such, I am not inclined to release the petitioner on bail rather this application is disposed of with direction to the trial court to expedite the trial and try to conclude it within a period of four months and if the trial is not concluded within the aforesaid period, he may renew his prayer for bail in the court below itself, which will be considered by the court below on the merit of the case.

Needless to say, accused persons has to cooperate in disposal of trial.
