Diary of the present case was called for which has since been received.

The petitioner, who happens to be the elder brother-inlaw of the deceased, has been in custody since 17.09.2017 in connection with Sugauli P.S. Case No. 172 of 2016 for the offence registered under Sections 304B, 201, 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the entire allegation against the present petitioner is general and omnibus and no specific role has been attached to him. It is further submitted that the petitioner has got no criminal antecedent. Considering the aforesaid facts and circumstances of the case and that there is no cogent material in the case diary to

Case No. 172 of 2016.
