JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 15-09-2020 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceeding. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 448/ 376/ 511/ 506/34 of the Indian Penal Code.

Allegation against the petitioner and other accused persons is of trying to rape with the informant and also snatched the Mangalsutra.

Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence and has been falsely implicated in this case. There is no specific overact allegation against the petitioner. The petitioner has got no criminal antecedent.

Learned APP for the State opposes the prayer for bail

I have perused the record, the case diary and eye witnesses have supported the prosecution case. In the aforesaid facts and circumstances, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected in connection with Sonepur P.S. Case No. 802 of 2019 from the Court of learned C.J.M., Chapra (Saran).

Accordingly, the application is dismissed.

However, petitioner is directed to surrender before the learned court below and make prayer for bail, the learned court below shall dispose of the bail petition on the same day without being prejudiced by this order.
