The petitioner seeks bail in connection with Puraini P.S. Case No. 65/2016 dated 18.08.2016 instituted for the offence under Section 395 of the Indian Penal Code.
The informant was waylaid by about 5 miscreants who were riding on two motorcycles. Later, one Vijendra Mehta @ Diga Mehta was arrested and he has disclosed the name of the petitioner.
Learned counsel for the petitioner has submitted that nothing has been recovered from the possession of the petitioner and he has not been put on T.I.P. It has further been submitted that same co-accused person, viz. Vijendra Mehta @ Diga Mehta has named him in three other cases, reference of which has been made
Patna High Court Cr.Misc. No.56592 of 2017 (2) dt.04-12-2017 2/2 in para 3 of the petition. In one of such cases, the petitioner has been granted bail.
Taking into account the period of custody of the petitioner in the present case, which is from 29.06.2017, this Court is inclined to grant bail to him.
The petitioner above named is directed to be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Uda Kishunganj, Madhepura in connection with Puraini P.S.
