Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 323, 341, 384, 504, 506 of the Indian Penal Code.
It is alleged that petitioner demanded extortion from the Manager and staff of petroleum dealership. It is submitted by learned counsel for the petitioner that petitioner filed Complaint Case No. 2276 of 2014 against the informant. Hence, as a retaliatory measure subsequently the informant's side filed Bhorey P.S. Case No. 153 of 2014. Moreover even assuming the accusation, no offence under Section 384 of the Indian Penal Code is made out.
The aforesaid facts constitute ground for
Patna High Court Cr.Misc. No.33893 of 2015 (2) dt.13-08-2015 2/2 consideration of prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Bhorey P.S. Case No. 149 of 2014, pending in the Court of learned Chief Judicial Magistrate, Gopalganj. Accordingly the application is disposed of.
