The petitioners seek regular bail in connection with Ara Town P.S. Case No. 515 of 2017 for the offences punishable under Sections 30/36 of the Bihar Prohibition and Excise Act, 2016.
The allegation is regarding recovery of 75 liters of illicit liquor upon the road and the petitioners were apprehended after they started fleeing away after seeing the police. The learned counsel for the petitioner submits that no recovery has been effected from the conscious possession of the petitioners and they have been falsely implicated in the present case. Patna High Court Cr.Misc. No.63642 of 2017 (2) dt.17-01-2018 2/2 antecedent and they are in custody since 9.10.2017. Considering the nature of accusation, the period of custody already undergone and the fact that the petitioners have a clean antecedent, the petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned A.D.J. 4, Bhojpur in Ara in connection with Ara Town P.S. Case No. 515 of 2017.
