The petitioner apprehends his arrest in a case registered for the offences punishable under Section 406 of the Indian Penal Code and under Section 138 of the Negotiable Instruments Act.

It is a case of cheque bounce. It is alleged that the cheques issued by the petitioner and was given to the complainant, got bounced due to insufficient fund. It is submitted that cheque in question was never issued by the petitioner rather from perusal of the complaint it is clear that the same was issued by co-accused Nasim Ahmad. Petitioner claims clean antecedents.

Considering the facts aforesaid, the petitioner above-

Patna High Court CR. MISC. No.20098 of 2023(2) dt.24-06-2023 2/2 named, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Sadar, East Champaran at Motihari in connection with Complaint Case No. 998 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
