JUSTICE SATYAVRAT VERMA ORAL ORDER 22-04-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Section 120B of the Indian Penal Code read with Sections 30(a), 32(2) and 41(1) of the Bihar Excise Act.
Learned counsel for the petitioner submits that the petitioner is in custody since 26.02.2022, is a person with clean antecedent and charge-sheet has been submitted in the case. Allegation is of recovery of 1278 litres of liquor from a vehicle.
Learned counsel for the petitioner submits that the petitioner was not arrested from the spot and his name is alleged to have been disclosed by a police spy. Learned counsel thus
Patna High Court CR. MISC. No.19571 of 2022(2) dt.22-04-2022 2/2 submits that the petitioner came to be implicated at the behest of the police through the spy.
Learned A.P.P. for the State opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody since 26.02.2022, is a person with clean antecedent, chargesheet has been submitted in the case and was not arrested from the spot, let the petitioner above named be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Mansoorchak P.S. Case No. 19 of 2022.
