2. The petitioner apprehends his arrest in connection with Jaynagar P.S Case No. 06 of 2024 registered for the offences punishable under Section 153(A) and 505(i) of Indian Penal Code and Section 66 of the Information Technology (Amendment) Ac, 2000.
3. As per the allegation in the FIR, on 02.01.2024 at about 23:10 P.M. informant- Gopal Krishna, A.S.I, Jaynagar got a screen-shot picture on his Whatsapp that accused persons are making wrong comments about each others gods and goddesses and religion, which can spread religious disharmony and the comment posted by both the persons has been made viral on
Patna High Court CR. MISC. No.22966 of 2024(2) dt.29-04-2024 2/2 social media with the aim of increasing enmity and hatred between two communities and spreading religious fanaticism.
4. Learned counsel for the petitioner submits that petitioner has been falsely been implicated in this case. He further submits that the petitioner is a man of clean antecedent as stated in paragraph no. 3 of the bail petition.
5. Learned counsel for the State opposes the prayer for bail of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, submissions made on behalf of the petitioner, let the above named petitioner be released on bail in the event of his arrest or surrender before the court below within a period of six weeks from today on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Madhubani in connection with Jaynagar P.S Case No. 06 of 2024 subject to the condition laid down under Section 438(2) of Cr.P.C.
