2. The petitioner has preferred this application for grant of regular bail in connection with Cyber P.S. Case No. 33 of 2024, registered for the offences punishable u/ss 255, 406, 420, 467, 468, 471, 120B of the Indian Penal Code and Sections 66C and 66D of the Information and Technology Act.

3. As per the prosecution case, the petitioner and the co-accused are alleged to have indulged in illegal withdrawing rupees from the bank account of the innocent people after taking their thumb impressions by using biometric machine, laptop, finger scanner and rubber stamp etc for committing cheating.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.21421 of 2025(2) dt.24-06-2025 2/3 that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 01.04.2024.

Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner and submitted that the regular bail application of the petitioner was earlier rejected by this court vide order dated 24.07.2024 passed in Cr. Misc. No. 47139/2024. It is further stated that on search, a laptop, mobile, ATM Card, PAN Card, biometric machine were recovered from the house of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Sitamarhi in connection with Cyber P.S. Case No. 33 of 2024 with the condition :- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
