JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 25-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.

On 19.04.2016 at about 06:00 a.m. Md. Amir proceeded towards Kolwara. At about 10:00 a.m., he (informant) received information regarding treatment going on at P.H.C., Parbatta. He along with others reached. On query, Md. Amir had disclosed that first of all Birendra Kumar @ Biro Mandal, Sanjay Mandal, Sale Mandal, Sudarshan Mandal, Bhola Mandal, Jogi Mandal assaulted Satan Mandal. Thereafter, he was also assaulted on the pretext of theft of goat. They have brutally assaulted. Maraiya Police arrived and rescued. As per instruction of the Doctor Md. Amir was being taken to Khagaria Hospital, he succumbed.

From the impugned order, it is evident that though

Patna High Court Cr.Misc. No.29264 of 2016 (2) dt.25-07-2016 2/2 ante injures were found over the person of deceased, however, there happens to be omnibus allegation and on account thereof, petitioner Sudarshan Mandal is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Khagaria in connection with Parbatta (Maraiya) P.S. Case No. 84 of 2016 corresponding to G.R. No. 834 of 2016.
