JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 302 and other minor sections of the Indian Penal Code, Section 27 of the Arms Act and Section 3⁄4 of Explosive Substance Act.

The present case was lodged in the year 1993 and petitioner is named accused but even after attachment of his property he could not be apprehended nor surrendered before the court below. Subsequently, on the strength of permanent warrant issued against the petitioner he could be caught by the police on 19.04.2016 and, thereafter, he could be remanded in this case. Considering the previous conduct of the petitioner as
