The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 384, 386 and 504/34 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation against the petitioner is that he opened fire due to which Suryamani Prasad @ Golki Yadav sustained gun shot injury.
It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. Petitioner has clean antecedent.
Learned APP appearing for the State opposed the anticipatory bail and submitted that the petitioner shot fire upon
Patna High Court CR. MISC. No.19606 of 2022(2) dt.28-09-2022 2/2 Suryamani Prasad @ Golki Yadav with an intention to kill him. He further submits that in the injury report of injured Suryamani Prasad @ Golki Yadav (Annexure-3 series) shows gun shot injury on the right foot and the doctor has opined the injuries to be grievous in nature and the offence is not compoundable in the eye of law.
After considering the aforesaid facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner.
Prayer for anticipatory bail of the petitioner is hereby rejected.
