JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-302/34 of the Indian Penal Code.
Petitioner happens to be father-in-law of the deceased. Paragraph-1 of the case diary goes to show that prior to receipt of the written report of the informant, the police got information that one woman has committed suicide but in the meantime, the informant reached the police station and gave written report, on the basis of which, the present case was lodged. However, in course of investigation, it came to light that the husband of the deceased was drunkard and the aforesaid habit of husband of the deceased invited a quarrel between him and the
Patna High Court Cr.Misc. No.28089 of 2016 (3) dt.26-09-2016 2/2 deceased.
Submission on behalf of petitioner is that the deceased was a Panchayat Teacher but subsequently, she had resigned from her post and being fed up with the aforesaid situation, she committed suicide.
Considering the above-said facts and circumstances of the case as well as submission of the parties and also keeping in mind that the investigation against the petitioner has already been completed., let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Kahalgaon (Rashalpur) P.S. Case No. 523 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur. (Hemant Kumar Srivastava, J) A.K.V./- U T
