The petitioner wants to renew the prayer of bail which was earlier rejected by order dated 01.12.2015 passed in Cr. Misc. No. 48102 of 2015 on the ground that the petitioner is suffering in custody since 04.01.2015. There is no allegation that the petitioner repeated the blow. No offence under Section 302 of the Indian Penal Code is made out and, as such, the petitioner deserves sympathetic consideration to which the learned A.P.P. has submitted that the petitioner is the assailant.

In the facts and circumstances stated above, finding no good ground for reconsideration of prayer for bail, again the prayer of bail of the petitioner stands rejected in connection with Pipra P.S. Case No. 41 of 2014 pending in the court of learned Sub-Divisional Judicial Magistrate, Masaurhi, District Patna.
