====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 20-09-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in Konch P.S. Case No. 41/2018, instituted for the offences under Sections 120(B), 353 and 386/34 of the Indian Penal Code read with Section 17 of C.L.A. Act and Sections 25(1-b)(1-anticipatory bail), 26 (2) and 35 of the Arms Act.

It is alleged in the written report that 1800 live cartridges sealed in pocket and 2202 set live cartridges, total 4002 live cartridges have been recovered from the land of this petitioner in buried condition.

Learned counsel for the petitioner has submitted that aforesaid land does not belong to the petitioner. It belongs to one

Patna High Court Cr.Misc. No.55725 of 2018 (2) dt.20-09-2018 2/2 Musafir Mahto. The petitioner has clean antecedent. He is in custody since 02.07.2018.

Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Konch P.S. Case No. 41/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
