The petitioners apprehend their arrest in a case registered for the offence under Section 307 & other minor sections of the Indian Penal Code and Section 27 of the Arms Act.

It is submitted on behalf of petitioners that as per F.I.R. itself, other co-accused persons are alleged to have fired. So far as these petitioners are concerned, there is no allegation of any overt act. They are simple member of the unlawful assembly and have got no criminal antecedent. Learned A.P.P. for the State has opposed the bail petition.

No.19556 of 2022(2) dt.31-08-2022 2/2 Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Sabour P.S. Case No. 265 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
