2. Heard learned counsel for the petitioner and learned A.P.P. for the State.

3. The petitioner seeks bail in connection with Riga P.S. Case No. 196 of 2022 dated 29.05.2022 registered for the offences punishable under Sections 363 and 366A/34 of the I.P.C.

4. As per the prosecution case, the petitioner and the co-accused Sushil Paswan and Manoj Paswan are alleged to have kidnapped the minor daughter of the informant.

5. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.21084 of 2024(3) dt.06-05-2024 2/3 this case. It is submitted that the petitioner went to the house of the co-accused Manoj Paswan who is the relative of the petitioner. The informant and the co-accused Manoj Paswan are the neighbours and there is no good relation between them. There was love affair between the parties. There is nothing on record to show that the victim was forced to illicit relationship with any another person. The occurrence took place on 27.05.2022 as to when the F.I.R. has been lodged on 29.05.2022 and for delay, no explanation has been given by the prosecution. The petitioner has clean antecedent as stated in paragraph no. 3 of the bail petition. He is in custody in this case since 31.05.2023.

6. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VI-cum-Special Judge (POSCO Act), Sitamarhi, in connection with Riga P.S. Case No. 196 of 2022 with further condition:-

No.21084 of 2024(3) dt.06-05-2024 3/3 (i) The petitioner is directed to remain physically present before the learned court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.
