JUSTICE SUDHIR SINGH ORAL ORDER 19-10-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 364, 365 and 120(B)/34 of the I.P.C. The allegation is that some unknown miscreants kidnapped Md. Yusuf, the elder brother of the informant when he was going to his house and later on his dead body was recovered. It has been submitted on behalf of the petitioner that the petitioner is in custody since 01.12.2015 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. There is no substantive evidence to suggest his implication in the present case. The other co-accused have

Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of Shri Ranjay Kumar, J.M., 1st class, Birpur, Supaul in connection with Karjain P.S. case No.43 of 2015 corresponding to G.R.
