The petitioner, who is in custody, seeks bail in connection with Ghogardiha P.S. Case No. 117 of 2017 registered for the offence punishable under Sections 379, 414 and 34 of the Indian Penal Code.

Informant is the Sub-Inspector in police station, he has stated that when he was in night patrolling duty he received information that two stolen motorcycles are kept in the garage of Md. Wasir and thereafter he seized said two motorcycles as no document of ownership could be produced by said Wasir and on his information he reached the house of Prem Lal Singh and one motorcycle was seized as no document could be produced by Sri

Patna High Court Cr.Misc. No.1279 of 2018 (3) dt.05-02-2018 2/2 Prem Lal Singh and on these information motorcycles were seized and persons were arrested.

Learned counsel for the petitioner submitted that he is innocent and he is not named in the FIR and has been falsely implicated in this case on the basis of confessional statement made by co-accused Md. Wasir and Prem Lal Singh. It has been further submitted that nothing has been recovered from his possession and he has clean antecedent and he is in custody since 17.11.2017. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., Jhanjharpur, Madhubani, in connection with Ghogardiha P.S. Case No. 117 of 2017.
